Please read these Terms of Service ("Terms") carefully before using the SanctScan sanctions screening platform and related services (the "Service"). SanctScan is a trading name of A. Wilderink Beheer, a sole proprietorship registered in the Netherlands ("SanctScan," "we," "our," or "us"). The Service is intended for use by businesses and professionals for compliance screening purposes.

SanctScan provides sanctions screening tools for informational purposes only. Our Service does not constitute legal, compliance, or professional advice. You are solely responsible for ensuring your compliance with all applicable sanctions laws and regulations. We strongly recommend consulting with qualified legal counsel for your specific compliance needs.

  1. Acceptance of Terms

By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy . If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

  1. Description of Service

SanctScan provides a sanctions screening platform that allows users to:

  • Search names against global sanctions lists (including OFAC SDN, EU Consolidated List, UN Consolidated List, UK HMT, and others)

  • Monitor entities for changes in sanctions status
  • Receive alerts when monitored entities' status changes
  • Generate screening reports for compliance documentation
  • Access sanctions screening via API for programmatic integration

  1. Not Legal or Compliance Advice

THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, COMPLIANCE, OR PROFESSIONAL ADVICE.

Our screening results are based on publicly available sanctions data and fuzzy matching algorithms. The Service:

  • Does not replace the need for professional legal or compliance advice

  • Does not guarantee the completeness or accuracy of sanctions data

  • Does not make determinations about whether a transaction should proceed

  • Should not be the sole basis for compliance decisions

You acknowledge that compliance with sanctions laws is complex and jurisdiction-specific. You are solely responsible for:

  • Determining which sanctions regulations apply to your business

  • Implementing appropriate compliance procedures
  • Making final decisions about matches and potential risks
  • Seeking qualified legal counsel when needed

  1. Account Terms

4.1 Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Be responsible for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4.2 Organization Accounts

Organization accounts allow multiple users to access the Service. The organization owner is responsible for:

  • Managing team member access and permissions
  • Ensuring team members comply with these Terms
  • Payment for the organization's subscription

  1. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service to violate any applicable law or regulation

  • Attempt to circumvent sanctions or other legal restrictions

  • Share your account credentials or allow unauthorized access

  • Resell, redistribute, or sublicense access to the Service without authorization

  • Use automated tools to scrape, harvest, or extract data beyond authorized API usage

  • Attempt to reverse engineer, decompile, or disassemble the Service

  • Interfere with or disrupt the Service or servers
  • Use the Service to transmit malware or harmful code
  • Impersonate any person or entity or misrepresent your affiliation

  1. Data and Content

6.1 Your Data

You retain ownership of any data you submit to the Service, including names and entities you screen ("Your Data"). By submitting Your Data, you grant us a limited license to process Your Data solely to provide the Service. You represent and warrant that you have a lawful basis and, where required, all necessary rights and permissions to submit Your Data — including any personal data of third parties — for screening.

6.2 Sanctions Data

The sanctions data used by our Service is sourced from publicly available government databases. We strive to keep this data current but cannot guarantee real-time accuracy. We update our databases regularly, but there may be delays between official sanctions list updates and our data refresh.

6.3 Screening Results

Screening results, including match scores and risk assessments, are generated algorithmically. These results:

  • Are indicative only and require human review and verification

  • May include false positives (non-matches flagged as potential matches) or false negatives (actual matches not identified)

  • Should be interpreted by qualified personnel in your organization

6.4 Data Processing

Where you submit personal data of third parties (such as names of individuals you screen), you act as the data controller and SanctScan acts as your data processor within the meaning of the GDPR. We process such data only to provide the Service and on your documented instructions, we apply the security measures described in our Privacy Policy, and we engage only the subprocessors listed there. Upon termination of your account, we delete or return such data unless retention is required by law. If you require a separately signed data processing agreement, contact us at legal@sanctscan.app.

  1. Payment and Subscriptions

7.1 Pricing

Our Service is offered under various subscription tiers with different usage limits. Current pricing is available on our Pricing page .

7.2 Billing

Paid subscriptions are billed in advance on a monthly basis. Purchases are processed by our payment partner Polar.sh, acting as merchant of record; Polar's own terms apply to the payment transaction. You agree to provide accurate billing information and authorize charges to your payment method. By starting a subscription, you request immediate access to the Service and acknowledge that any statutory right of withdrawal may be affected accordingly.

7.3 Overage

If you exceed your plan's usage limits, you may be charged overage fees or required to upgrade your plan, as specified on our Pricing page.

7.4 Refunds

We do not provide refunds for partial months of service or unused features. If you cancel your subscription, you will retain access until the end of your current billing period.

  1. Intellectual Property

The Service, including its design, features, content, documentation, and underlying technology, is owned by SanctScan and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

  1. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The Service will meet your specific requirements or expectations

  • The Service will be uninterrupted, timely, secure, or error-free

  • Screening results will be accurate, complete, or reliable
  • The sanctions data will be current or comprehensive
  • Use of the Service will ensure compliance with applicable laws

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SANCTSCAN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Any loss of profits, revenue, data, or business opportunities

  • Any damages arising from your reliance on screening results

  • Any failure of the Service to identify a sanctioned or listed party (a "false negative"), or any incorrect identification of a match (a "false positive")

  • Any penalties, fines, or sanctions imposed by regulatory authorities

  • Any damages resulting from transactions with sanctioned parties

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits our liability for damages resulting from our own intent or willful recklessness, or any other liability that cannot be excluded or limited under applicable law. If you use the Service as a consumer, nothing in these Terms affects your mandatory statutory rights.

  1. Indemnification

You agree to indemnify, defend, and hold harmless SanctScan and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any claim that your compliance decisions caused harm to a third party

  1. Termination

12.1 By You

You may terminate your account at any time by contacting us at legal@sanctscan.app. Upon termination, your right to use the Service will cease immediately.

12.2 By Us

We may suspend or terminate your access to the Service at any time if:

  • You breach these Terms
  • We are required to do so by law
  • We reasonably believe your use poses a security risk
  • Your account has been inactive for an extended period

12.3 Effect of Termination

Upon termination, your right to access the Service will cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

  1. Dispute Resolution

If you have a dispute with us, please contact us first at legal@sanctscan.app — most issues can be resolved informally. Any dispute arising from these Terms or your use of the Service that cannot be resolved informally shall be submitted exclusively to the competent court in Amsterdam, the Netherlands, unless mandatory applicable law provides otherwise.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

  1. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

For significant changes that materially affect your rights, we will provide at least 30 days' notice via email or through the Service before the changes take effect.

  1. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SanctScan regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
